INTRODUCTION

These General Terms and Conditions of Sale regulate the purchases of products and services, made at a distance by the purchaser (hereinafter referred to as “Customer “) via the Internet on the website www.Citislab.it (hereinafter referred to as “Citislab.it”) belonging to CitisLab Comunicare Itinerari sensoriali S.r.l. (hereinafter referred to as “CitisLab”) with registered office in Via Cefalonia 55, Brescia, P.Iva and C.F. 04643140983 and registered in the Companies’ Register BS-630039

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The contract between CitisLab and the Customer shall be deemed to be concluded upon acceptance of the order by CitisLab. Such acceptance shall be deemed tacit unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he/she is of legal age and has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the general conditions of sale and payment transcribed in the following points.
If the Customer is a consumer (i.e. an individual who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he/she will print or save an electronic copy and otherwise retain these general conditions of sale.
It is excluded any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance, even partial, of an order.

METHOD OF PAYMENT

Credit Card (Stripe) / PayPal

In cases of purchase of goods by payment method Credit Card or PayPal account, at the same time as the conclusion of the online transaction, the bank of reference will authorize the amount related to the purchase made.
In case of cancellation of the order, in whole or in part, either by the Customer or in case of non-acceptance of the same by Citislab, it will be requested simultaneously by Citislab the cancellation of the transaction and the reversal of the amount charged. Once the cancellation of the transaction has been made, under no circumstances can CitisLab be held liable for any damages, direct or indirect, caused by delay in the failure of the banking system to release the amount committed.
CitisLab reserves the right to ask the Customer for additional information such as a landline phone number or to send copies of documents proving the ownership of the Card used. In the absence of the required documentation, CitisLab reserves the right not to accept the order.
At no time during the purchase process is Citislab able to know the buyer’s credit card information or PayPal account details. No CitisLab computer file will retain such data. Under no circumstances, therefore, can CitisLab be held liable for any fraudulent and improper use of credit cards by third parties when paying for products purchased on www.citislab.it.

Bank Transfer in Advance

In case of payment by bank transfer in advance, the order can be considered confirmed only upon the actual crediting of the amount due to Citislab’s bank account, which must take place within 5 (five) working days from the date of the order. Beyond these deadlines, the order will be automatically cancelled.
Until credited, the order placed does not constitute a reservation of the chosen items. The purchased goods will be processed (if available), only when the full amount is credited.
The reason for the bank transfer must necessarily state:

• Order number placed at Citislab
• First and Last Name of the order holder

Bank charges, incurred for the transfer, are exclusively borne by the Customer himself.
If the products are no longer available due to out of stock, Citislab will as soon as possible to re-credit the amount to the Customer’s bank account at no charge to the same.

MODE OF PURCHASE

The Customer may purchase the products in the electronic catalog of CitisLab.it at the time of placing the order and viewable online at http://www.citislab.it, as described in the relevant information sheets. It is understood that the picture of the descriptive sheet of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the picture. All supporting information for purchase is intended merely as general information material.
The correct receipt of the order is confirmed by CitisLab by means of an e-mail reply, automatically sent to the e-mail address provided by the Customer. This confirmation message will contain the date and time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with CitisLab. The message will repeat the items ordered, shipping costs, any additional costs, discounts applied and all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections, as described in this document.
In case of non-acceptance of the order, CitisLab ensures timely notification to the Customer.
All prices on the citislab.it website are intended as retail prices and, therefore, include vat. Wellstore reserves the right to change prices at any time without prior notice.

DELIVERY METHODS AND CHARGES

Citislab can only accept orders with delivery within Europe. Excluded are deliveries to locations in Livigno and Campione d’Italia and to Mail Boxes or companies that provide domiciliation services
Transportation costs are borne by Citislab for amounts over 200 (two hundred) euros, except:

• Any extra surcharges for excessively bulky and/or heavy goods explicitly highlighted when placing the order.
• Any storage and transportation costs incurred if the goods are not picked up.
• Any charges for delivery to inconvenient locations (smaller islands, Venice) .
• Any charges for delivery to the floors

For amounts less than 200 (Two Hundred) euros Citislab charges a contribution for transportation costs equal to the amount indicated during the order process.
No responsibility can be attributed to Citislab in case of delay in processing the order or delivery of what has been ordered.
Delivery of what has been ordered is intended to be at street level, it is possible to request delivery to upper floors where possible, by requesting Citislab prior to the processing of the goods, the additional service which will involve an additional cost agreed in advance.
Floor delivery service is possible only if the essential conditions for performing the service exist and subject to the approval of the carrier.
Upon delivery of the goods by the carrier, the Customer is required to check that:

• the number of packages being delivered corresponds to what is indicated in the transport documents
• the packaging is intact, not damaged, or wet or otherwise altered.

Any damage to the packaging and/or product, or mismatch in the number of packages or indications, must be immediately contested by marking “Received subject to verification for “indicate the reason for the reservations” on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer may not object to any dispute about the external characteristics of what has been delivered (Art. 1698 Civil Code).
Any anomaly must then be reported within eight days by writing to info@citislab.it pointing out all order references, a copy of the conditionally signed waybill, and photographic documentation of the damage;
Any problems concerning the physical integrity, correspondence, or completeness of the products received must be reported within 7 days of delivery in the manner provided herein.
In the event that the customer does not collect within 5 (five) working days the goods ordered and present in storage at the warehouses of the courier company due to the repeated inability to deliver to the address indicated by the customer at the time of the order, what was ordered will be returned to the warehouses Citislab and will be charged for the transportation costs incurred.
Payment for the goods by the Customer will be made using the method chosen when placing the order.
Orders for amounts less than 100 (one hundred) euros are not accepted.

PRODUCT AVAILABILITY

The Customer can purchase the products featured on CitisLab.co.uk when placing an order. The pictures and technical data accompanying the sheet of a product may not be complete and exhaustive of its own characteristics but different for example in color or size.
The indicated availability of the displayed product is purely indicative, given the possibility of multiple purchases at the same time by multiple users. For this reason Citislab reserves the right, once the order is received, to check the availability of the existing good at its warehouse or at the manufacturer’s warehouse and, failing that, to communicate any updated delivery forecasts. The Customer may request the cancellation of the order, even partial, and the refund of the corresponding amount if already paid.

RIGHT OF WITHDRAWAL

Pursuant to the Consumer Code that regulates distance sales (Legislative Decree 206/2015), if the customer is a “consumer” (i.e. a natural person who purchases goods for purposes not related to his or her professional activity, i.e., does not make the purchase by indicating in the order form to Citislab a VAT number reference), he or she has the right to withdraw from the purchase contract for any reason, without penalty. In addition to their rights under the law, products purchased on citislab.co.uk, can be returned within 14 days calendar days from delivery (except for products listed in 8.8, for which the right of withdrawal is excluded by law.
In accordance with the law, shipping costs related to the return of the goods are the responsibility of the customer.
Shipment, until the certificate of receipt in the Citislab warehouse, is the complete responsibility of the customer;
In accordance with the law, the initial standard shipping costs incurred to receive the product will also be returned except for products for which withdrawal is requested more than 14 days after receipt.
Additional costs highlighted and accepted by the Customer, at the time of filling the order, will not be reimbursed (floor transportation, assembly service, telephone appointment, surcharge for bulky goods, etc.)
The products must be returned within 14 days from the day on which the customer has communicated the exercise of the right of withdrawal, substantially intact and functional, in their original packaging, complete with all its parts and accessories (including any warranties, instructions, user licenses, cables, etc. …), without any lack kept and possibly used according to normal diligence, without any signs of wear or dirt.
The right of withdrawal can be exercised in connection with the purchase of any product on Citislab.co.uk, with the exception of:

• Custom packaged items, handcrafted made-to-order or clearly customized items, or items that are likely to deteriorate or expire quickly (Typically Touch Panels and Tactile Tables made ad hoc to customer specifications)
• Sealed goods that are not suitable for return for hygienic or health protection-related reasons and that have been opened after delivery or in the case of products that are, after delivery, inseparably mixed with other goods
• you can not exercise withdrawal only on part of the purchased product (eg: accessories, attached software, etc. …),

Citislab may withhold from reimbursement an amount corresponding to the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics, and operation of the goods. For example:

• The use of the asset that has compromised its integrity or the use of any consumables.
• The lack of the original outer packaging and/or inner packaging;
• The absence of integral elements of the product ;
• damage to the product and obvious signs of wear and tear or assembly.

Citislab will process the refund within 14 days of the exercise of the right of withdrawal. the refund may be held beyond 14 days only until the consumer has demonstrated that he/she has sent back the goods or until the goods have been received by us, whichever comes first. The refund will be made in the same manner used by the Customer for the purchase i.e., by bank transfer, credit card transfer, PayPal refund .
In order to exercise the right of withdrawal, the Customer is required to inform Citislab Srl, headquartered at Via Cefalonia 55 20145 Brescia (BS), Whatsapp Customer Service Number 3759421229 email: info@citislab.it, of your decision to withdraw from this contract by an explicit written statement e.g. letter sent by post or email.

BILLING

For each order Citislab will issue a tax receipt or invoice if explicitly requested when filling the order. Pursuant to art 14 D.P.R. 445/2000 and DL 52/2004, the invoice or receipt will be generated within 12 days after the confirmation of the order and its payment.
For the issuance of the invoice/receipt, the information provided by the Customer at the time of the order shall be binding.
No changes in the invoice / receipt will be possible, after the issuance of the same.
In case of orders processed in several shipments, several separate invoices or receipts may be generated, linked to each shipment.

ORDER CANCELLATION

All orders are binding and can be cancelled only and exclusively if the goods have not yet been shipped through, by writing to info@citislab.it. For orders that have already been processed, the customer must exercise the right of cancellation.

PRIVACY

The personal data requested when placing the order are collected and processed for the purpose of fulfilling the Customer’s express requests and will not under any circumstances or for any reason be passed on to third parties. Citislab guarantees its customers compliance with the legislation on the processing of personal data, governed by the Privacy Code under DL 196 of 30.06.03.
The data controller is Citislab S.r.l. in the person of the legal representative.
The Client, at any time, has the right to withdraw consent to the processing of personal data by written notice to be sent to the registered office of Ciotislab.
The Customer, who declares to have received the information pursuant to art. 13 and on the rights due to him, pursuant to art. 7 of Legislative Decree no. 196/2003, has the right to access his data in the manner provided therein.
Marketing communications will be sent only with the explicit consent of the Client issued together with the authorization for processing and sending in the online registration form.

JURISDICTION AND VENUE

The sales contract between the Customer and CitisLab is concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Brescia.
Citislab informs the user who holds the status of consumer under Article 3, paragraph 1, letter a) of the Consumer Code that a European ODR platform for online resolution of consumer disputes has been established . The ODR platform can be accessed at the following address. https://ec.europa.eu/consumers/odr/main/?event=main.home.show ; through the ODR platform, the consumer user will be able to consult the list of ADR entities, find the link to the site of each of them, and initiate an online, non-judicial resolution procedure for the resolution of any dispute arising from the online contract concluded on this site.

CHANGES AND REVISIONS

The conditions contained in this document may be changed by Citislab without prior notice and will be valid from the date of publication on Wellstore.co.uk.
